Terms of Service

These Terms of Service form a binding agreement between you and Chad vs Chud (“we”, “us”). By clicking the consent button on the landing page you affirmatively agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old to use Chad vs Chud. We do not offer the service to anyone under 18 and we do not support a verifiable-parental-consent path. By accepting these Terms you represent that the birthdate you entered on the consent gate is true and that you are at least 18 years old as of today. Misrepresenting your age is a material breach of these Terms.

You are responsible for keeping minors away from your camera while you use the service. If a minor uses the service from your device, you must immediately stop using Chad vs Chud and request data deletion at /delete-my-data.

2. Acceptable use

You agree that you will:

• Show only your own face, live, in real time. No photos, no video playback, no holding up a different person, no impersonation, no presenting a child or any other person who has not consented.
• Not harass, dox, threaten, or sexually harass other users, attempt to identify them outside Chad vs Chud, or use the chat / report features in bad faith.
• Not transmit explicit, sexual, violent, hateful, or otherwise illegal content via your camera. Sexual content involving minors is forbidden absolutely and will be reported to the National Center for Missing and Exploited Children (NCMEC) under 18 U.S.C. § 2258A and to law-enforcement authorities.
• Not attempt to game the rating system — via filters, deepfakes, replayed footage, multiple accounts, or scripted clients.
• Not scrape, mass-download, or republish any face images, handles, or scoring data without our written permission.

Violation is grounds for immediate, permanent ban without warning, plus an IP-level rate limit that may also affect others on your network.

3. Public display of your face

You acknowledge and agree that the face image we capture during your rounds will be displayed publicly within the service: on the Vote page where strangers rank pairs of faces, on the Top 100 leaderboard, and on round-result screens shown to your match opponent. You grant Chad vs Chud a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and distribute that face image solely within the Chad vs Chud service for the purposes described in the Privacy Policy. This license terminates when you delete your data; we will remove the relevant images within 30 days.

4. What the score means

Scores reflect a model's prediction of conventional perceived attractiveness on a 0–10 scale. They are not a measure of your worth as a person. The model has known limitations and biases — please read our Bias Notice before drawing conclusions about a number we put under your face.

The output is AI-generated. There is no human reviewer producing the score in real time. Chad vs Chud combines several machine-learning models: a CNN trained on the public SCUT-FBP5500 dataset, an ArcFace embedding regressor, and an LLM-based pairwise judge. They will be wrong sometimes. They will be unfair sometimes.

5. Service availability

We may take Chad vs Chud offline for maintenance, model retraining, geo- graphic compliance reasons, or because the GPU bill got scary, without notice. We do not promise uptime SLAs.

6. Account, data, deletion

You may use Chad vs Chud anonymously with a handle, or sign in with Google. Round history and ELO are tied to your handle (or your Google account, if signed in). To delete data, visit /delete-my-data or email privacy@chadvschud.com. See the Privacy Policy for what gets deleted and what we retain as legal evidence.

7. Reporting abuse, minors, or CSAM

If you encounter a minor on Chad vs Chud, sexually explicit content, threats of violence, or any other suspected illegal conduct, report it via the /abuse page or email abuse@chadvschud.com. CSAM (child sexual abuse material) reports are forwarded to the NCMEC CyberTipline as required by 18 U.S.C. § 2258A.

8. Intellectual property & DMCA

Chad vs Chud, its UI, models, brand, and code are owned by us or our licensors. You retain ownership of the face image you submit; you grant us only the limited license described in §3 above.

If you believe content on Chad vs Chud infringes your copyright, send a DMCA notice to our designated agent at dmca@chadvschud.com. Notices must include the elements required by 17 U.S.C. § 512(c)(3). See /abuse for the full process.

9. AI-generated content disclaimer

Scores, qualitative judgments, and any text produced by the AI judge are generated by machine-learning models without human review. They may be inaccurate, unfair, biased, or offensive. Do not rely on them for any consequential decision about yourself or another person.

10. Limitation of liability

Chad vs Chud is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or emotional distress, arising out of or related to your use of Chad vs Chud. Our total aggregate liability for any claim arising from these Terms will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to indemnify and hold Chad vs Chud and its operators harmless from any claim, damages, or costs (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) content you transmit through the service; (c) your violation of any third party's rights, including privacy, publicity, or intellectual property rights; or (d) your violation of any law.

12. Binding arbitration & class-action waiver

Please read this section carefully — it affects your legal rights.

You and Chad vs Chud agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Chad vs Chud will be resolved by binding individual arbitration and not in a court, except that you may bring claims in small-claims court if eligible. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, in the State of Delaware, USA, in English. Each party will bear its own costs except as the AAA rules require otherwise.

Class-action waiver.You and Chad vs Chud agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to legal@chadvschud.com within 30 days of first accepting these Terms. The notice must include your handle, the email address you used to sign up (if any), and a clear statement that you wish to opt out of arbitration.

If this arbitration provision is found unenforceable in whole or in part, the unenforceable portion will be severed, and the remainder (including the class-action waiver) will continue in effect.

13. Governing law & venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Subject to the arbitration agreement above, any action that proceeds in court must be filed in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these Terms. Material changes trigger a re-consent prompt the next time you visit the service. Continued use after a re-consent prompt is shown is not sufficient acceptance — you must affirmatively accept the new Terms.
